Step 4 of 5

Living in Your THI Home

Your monthly payment goes toward buying your home. Here is when it is due, how it is set, and what you and THI each take care of.

The kitchen of a new THI home with wood cabinets, a black range, refrigerator and dishwasher, and sunlight across a tile floor.
  • The 1st payment due date, late after the 5th
  • $25 late charge, waived on payroll deduction
  • 30 days to finish repairs found at an inspection

Your monthly payment

Payments are due on the 1st of each month. A payment that reaches THI after the 5th is late and adds a $25 late charge. If the 5th falls on a day the THI office is closed, you can pay the next business day.

Pay online, in person at the THI office, by mail to 37B Day School Road, Santa Ana Pueblo, NM 87004, or by payroll deduction. THI charges $35 for a returned check.

If you can't pay on time

Call THI at (505) 771-2060 as soon as you know a payment will be late. If the full payment is not in by the 5th, THI sends a Notice of Noncompliance and asks you to pay or meet to agree on a plan.

How your payment is set

Your payment depends on when your Lease Purchase Agreement started. For most low-income families it is 30% of adjusted income or a set amount, whichever is less.

Monthly payment for low-income homebuyers, by when you moved in under your Lease Purchase Agreement
When you moved in Your monthly payment 3 bedrooms 4 bedrooms 5 bedrooms
Before February 2000 30% of adjusted income or the amount for your home size, whichever is less $200 $240 $280
February 2000 through November 2008 30% of adjusted income or the amount for your home size, whichever is less $200 $240 $280
After November 2008 through January 1, 2025 30% of adjusted income or the amount for your home size, whichever is less, and at least the $250 administration charge $275 $325 $355
On or after January 1, 2025 The monthly amount that pays off your purchase price over 30 years, or 30% of adjusted income, whichever is less, and at least the administration charge Set by your purchase price

Families above the low-income limit pay under a separate formula in Section V.C.1.e.

You may pay more than your required payment. Extra payments go toward your purchase price.

Recertification

If your income drops or your family changes and your payment is now more than 30% of your adjusted monthly income, ask THI to recertify your income. A lower payment starts on the 1st of the month after you report the change. THI tells you about any change in writing within 10 days.

Maintenance and repairs

You take care of your home's maintenance and repairs and pay your own utilities. THI handles warranty items you report during the warranty period and repairs covered by its insurance. If something breaks that the warranty covers, tell THI right away.

If a Homebuyer fails to report such a deficiency or breach in time, and THI is subsequently unable to obtain redress under the warranty, correction of the deficiency shall be the responsibility of the Homebuyer.

Inspections

In the Homeownership Program, THI inspects every home inside and out once a year and gives you a copy of the report. You have 30 days to finish the repairs it lists. If your home has a problem that threatens anyone's health or safety, THI inspects right away and addresses it within 10 days.

If your home came under the Tribally Funded Policies, Section IV.E of those policies applies: after five years in full compliance, THI may inspect every three years.

Insurance

In the Homeownership Program, THI insures your home against fire and other risks home insurance usually covers until it is conveyed to you. Your own belongings are yours to insure. If fire or other damage forces you to move out while the home is repaired, and you did not cause it, your payments stop until you can move back.

If your home came under the Tribally Funded Policies, you buy homeowner's insurance when you move in (Section IV.F of those policies).

If you disagree with a decision

You can file a grievance in writing within 30 days of an Adverse Action, as Section XI defines it: a decision that you must move to another home, a determination of charges you owe or of your monthly payment, a settlement amount when your agreement ends, or another THI action contrary to your interests. A hearing officer hears it, you can bring someone to represent you, and there is no fee, though THI does not have to start or continue a hearing while your account is delinquent. You get a written decision within 10 days of the hearing, and either side can ask the THI Board to review it.

Grievances do not cover THI's decisions on general policy, including the administration charge, or lease terminations, which have their own appeal process in Section IX.E.
