intentional disregard of City Ordinances and City Notifications of Violations and potentially State Law. The Planning Commission Package does not indicate what, if any, corrections and / or penalties may be assessed! It appears these violations may get swept under the rugs at city hall! My request is that City Council should investigate each potential violation and take immediate and appropriate actions. I further suggest treating the investigations and resulting actions, if necessary, as two separate issues.
Issue Number One: A Planning Commission member apparently willfully violated the City Ethics and Zoning Ordinances and has demonstrated Misfeasance, Malfeasance and Nonfeasance in that position. Possible Remedy Per the Michigan Planning Enabling Act : (9) The legislative body may remove a member of the planning commission for misfeasance, malfeasance, or nonfeasance in office on written charges and after a public hearing….
Issue Number Two: Home owners likely willfully violated the Zoning Ordinances and potentially the homestead property tax credit law. Possible Remedy: Investigate each violation for enforcement actions and apply penalties to the fullest extent allowed
