RE GULAR MEETING OF THE CITY COUNCIL OF THE CITY OF EAST RI DGE May 14, 2026 6:00 p.m. The East Ridge City Council met pursuant to the meeting notice on May 14, 2026, at 6:00 p.m. in the East Ridge City Hall Council Chambers. Mayor Brian Williams called the meeting to order. Jeff Baden, Senior Pastor of Hamilton Life Church, gave the invocation. All present joined in for the Pledge of Allegiance. Present: Mayor Brian Williams, Vice Mayor David Tyler, Councilmember Jacky Cagle, Councilmember Jeff Ezell, Councilmember Andrea Witt, Interim City Manager Mike Williams, City Attorney Mark Litchford, Finance Director Diane Qualls, City Clerk Jennifer Deitrick Attendance: Approximately 29 members of the public were present. Milestone Awards Mayor Williams recognized Michelle Sinigaglio and Jonah Goddard for five years of service each and Christopher Cope for 10 years of service. Approval of Consent Agenda Councilmember Witt moved to approve the Consent Agenda. Vice Mayor Tyler seconded. There being no discussion, Mayor Williams called for a roll call vote. Vice Mayor Tyler - yes; Councilmember Cagle - yes; Councilmember Ezell -yes; Councilmember Witt -yes; Mayor Williams -yes. Motion carried unanimously. Communication from Citizens Mayor Williams opened the floor for public comments. No citizens came forward to address the Council. Communication from Councilmembers Councilmembers Cagle and Witt reported no comments. Vice Mayor Tyler announced that the East Ridge Optimist Club's 13th Annual Fishing Rodeo will be held on June 6, 2026, and registration is open on the Optimist Club's website. Councilmember Ezell reported a citizen inquiry regarding paving improvements on Mack Smith Road and asked whether the entire roadway could be paved. Interim City Manager Williams stated prior evaluations by staff and consultants determined that full paving was not necessary for all segments. Councilmember Ezell expressed his preference that the entire roadway be paved. Mayor Williams announced the Hands Across the Border event on May 21, 2026, and the Police Department's Spring Into Safety event on May 23, 2026, highlighted library programming, noted volunteer and foster opportunities at the Animal Shelter, and recognized Donald Rogers for 31 years of service with the City. He then reported attending East Ridge High School Senior Day and congratulated the Class of 2026. Communication from Interim City Manager Interim City Manager Williams reported that the Library requested approval to remove shrubbery, install sod, and add tables, benches, and a fence, at an estimated cost of $6,000. He noted a bench would be dedicated in memory of a Library employee who passed away earlier this year. Councilmember Cagle noted the City Manager's purchasing authority and moved to approve the request. Vice Mayor Tyler seconded. The motion passed unanimously. New Business PUBLIC HEARING FOR ORDINANCE NO. 1244 - AN ORDINANCE OF THE EAST RIDGE CITY COUNCIL TO AMEND THE ZONING REGULATIONS AND THE ZONING MAP OF THE CITY OF EAST RIDGE, TENNESSEE SO AS TO REZONE THE PROPERTY LOCATED A-T 1502 SWOPE DRIVE, TAX MAP #169K-B-003, FROM R-2 RESIDENTIAL DUPLEX DISTRICT TO C-2 GENERAL COMMERCIAL DISTRICT City Attorney Litchford read the ordinance on caption. Mayor Williams opened the public hearing. Chief Building Official Howell stated that the Planning Commission recommended approval. He reviewed the historical zoning of the subject property and neighboring properties and recommended conditions including installation of a privacy fence, building height limitations, lighting guidelines and use restrictions. Applicant William Benjamin Chandler agreed to the conditions and stated that all assembly work would be performed inside the building. Council discussion addressed delivery logistics, operational impact, and neighborhood concerns. Mr. Chandler confirmed no outdoor storage, no obstruction of Swope Drive, and minimal impact. The following individuals expressed opposition to the rezoning request: Ashley Bankston of 222 Boring Street, Rossville, Georgia 30741; Edna DeGarmo of 12 Woodard Circle; Elaine Powell of3 Woodard Circle, who also presented 30 signatures from neighbors opposing the proposed rezoning; David Silver of 1 Woodard Circle; Drenda Voiles of 27 Woodard Circle; James Voiles of 27 Woodard Circle; Frank DeGarmo of 12 Woodard Circle; Margie Posey of 1510 Swope Drive; and Ernie Powell of 3 Woodard Circle. Mayor Williams inquired about locating the facility at Easy Auto. Mr. Chandler stated this would reduce needed inventory space. There being no further comment, Mayor Williams closed the public hearing. ORDINANCE NO. 1244 - AN ORDINANCE OF THE EAST RIDGE CITY COUNCIL TO AMEND THE ZONING REGULATIONS AND THE ZONING MAP OF THE CITY OF EAST RIDGE, TENNESSEE SO AS TO REZONE THE PROPERTY LOCATED AT 1502 SWOPE DRIVE, TAX MAP #169K-B-003, FROM R-2 RESIDENTIAL DUPLEX DISTRICT TO C-2 GENERAL COMMERCIAL DISTRICT (1st READING) City Attorney Litchford read the ordinance on caption. PUBLIC HEARING FOR ORDINANCE NO. 1245 - AN ORDINANCE OF THE EAST RIDGE CITY COUNCIL TO CREATE A NEW CHAPTER 11 UNDER TITLE 9 OF THE EAST RIDGE MUNICIPAL CODE ESTABLISHING REGULATIONS FOR OPERA TING A MOBILE FOOD VENDING BUSINESS WITHIN THE CITY OF EAST klUGE, TENNESSEE May 14, 2026 Council Meeting Page 2 of5 City Attorney Litchford read the ordinance on caption and stated that the Planning Commission recommended approval. Chief Building Official Howell explained that the ordinance creates a regulatory framework for food truck operations. Mayor Williams opened the public hearing. Kenny Kuster of 6739 Ringgold Road expressed concerns regarding how the ordinance may affect existing contracts, as well as certain language within the ordinance. He stated support for regulation but emphasized the importance of maintaining fan engagement and overall experience. Mayor Williams and City Attorney Litchford clarified that implementation would include overlay districts and that a phased implementation period could allow time to accept applications for such overlay zones. William and Jaime Worley of 13 l 8 West End Ave spoke in support of an ordinance that would allow them to operate their food truck within the City. Mayor Williams closed the public hearing. ORDINANCE NO. 1245 - AN ORDINANCE OF THE EAST RIDGE CITY COUNCIL TO CREATE A NEW CHAPTER 11 UNDER TITLE 9 OF THE EAST RIDGE MUNICIPAL CODE ESTABLISHING REGULATIONS FOR OPERATING A MOBILE FOOD VENDING BUSINESS WITHIN THE CITY OF EAST RIDGE, TENNESSEE (1st READING) City Attorney Litchford read the ordinance on caption. Following clarification that the vote pertained to the ordinance and that overlay districts would be addressed through a case-by-case application process, Vice Mayor Tyler moved to approve Ordinance No. 1245. RESOLUTION NO. 3814 - A RESOLUTION OF THE EAST RIDGE CITY COUNCIL TO AUTHORIZE AND APPROPRIATE FUNDS FOR AN ACTUARIAL STUDY TO DETERMINE THE COST(S) ASSOCIATED WITH ESTABLISHING THE SUPPLEMENTAL BRIDGE BENEFIT UNDER TENNESSEE CODE ANNOTATED, TITLE 8, CHAPTER 34, SECTION 211 FOR CERTAIN MEMBERS OF THE TENNESSEE CONSOLIDATED RETIREMENT SYSTEM City Attorney Litchford read the resolution on caption. Police Chief Uselton stated the estimated cost of the actuarial study is approximately $400 and would determine the City's cost to implement the new state-offered retirement benefit for first responders. Parks and Recreation Director Skiles stated the Crestwood Garden Club requested a fee waiver for use of the Community Center for meetings scheduled from February through June and September through December. RESOLUTION NO. 3817 - A RESOLUTION OF THE EAST RIDGE CITY COUNCIL TO DECLARE CERTAIN PROPERTY OWNED BY THE CITY TO BE SURPLUS TO THE CITY'S NEEDS AND DIRECTING DISPOSAL OF SAME City Attorney Litchford read the resolution on caption and explained that Boyd Buchanan School requested to purchase the mower at the higher end of its estimated value. Parks and Recreation Director Skiles noted that surplus items are typically sold through an auction site, which does not guarantee a sale price. Vice Mayor Tyler moved to approve Resolution No. 3817. ORDINANCE NO. 1245 - AN ORDINANCE OF THE EAST RIDGE CITY COUNCIL TO CREATE A NEW CHAPTER 11 UNDER TITLE 9 OF THE EAST RIDGE MUNICIPAL CODE ESTABLISHING REGULATIONS FOR OPERATING A MOBILE FOOD VENDING BUSINESS WITHIN THE CITY OF EAST RIDGE, TENNESSEE (2nd READING) City Attorney Litchford read the ordinance on caption and stated he will present the ordinance for second reading based on the discussion of the Council during first reading. New Business PUBLIC HEARING AND FIRST READING: ORDINANCE NO. __ - Rezone 403 Donaldson Road, Tax Map# 156E L 007.01, from R-1 Single Family Residential District to R-2 Residential Duplex District Chief Building Official Howell stated the property is a legal nonconforming duplex that would be brought into compliance if rezoned to R-2. He noted Council previously approved a similar rezoning at 416 Donaldson Road. May 14, 2026 Council Meeting Page 4 of 5 PUBLIC HEARING AND FIRST READING: ORDINANCE NO. - Amend Ordinance 941 relative to Title 10, Chapter 2 Entitled Dogs and Cats relative to the registration of dogs and cats City Attorney Litchford explained that the amendment removes the blanket registration requirement for dogs and cats, requires vaccination compliance for dogs at the dog park, and mandates registration for animals that have been picked up by animal control. Following questions from Councilmember Cagle, discussion followed regarding feral cats, the shelter's designation as a no-kill shelter, and transferring animals to areas that do not have animals to adopt. PUBLIC HEARING AND FIRST READING: ORDINANCE NO. - An ordinance to submit in referendum the question of amending the charter of the City of East Ridge, Tennessee by amending Section 5-A of the Charter City Attorney Litchford stated that a resolution adopted in 2013 allowed Councilmembers to participate in City health benefits in the same manner as a full-time employee. The proposed amendment would clarify that a Councilmember may not participate in City-provided health benefits unless the cost is fully borne by the Councilmember. Approval would place the question on the November election ballot. RESOLUTION NO. __ - Approval of bid for the demolition and replacement of cabinets and countertops at the East Ridge Community Center Parks and Recreation Director Skiles stated that bids will open on May 20, 2026. RESOLUTION NO. __ - Approval of a contract with AMS Collection Services for the collection of delinquent court fines City Attorney Litchford City Attorney Litchford explained that the contract would allow for collection of outstanding court fines. Following a question from Councilmember Cagle, Finance Director Qualls reported the previous agency was not effective and explained that Court Clerk Cassidy received positive feedback from other jurisdictions who utilize AMS Collection Services. Presentation of the Fiscal Year 2026-2027 Budget Finance Director Qualls stated City Manager Koral would present the proposed budget and briefly reviewed current economic factors impacting the budget. Mayor Williams announced that the Spring into Safety event had been postponed, with a new date to be determined; shared information regarding upcoming Library programs and events, as well as Animal Shelter adoptions, trial adoptions, foster opportunities, and volunteer opportunities. He thanked Vice Mayor Tyler for speaking at the Memorial Day event; and invited Chief Williams to speak regarding the newly installed baby box at Fire Station No. 1. City Council and City Manager Koral honored Chief Williams for his service as Interim City Manager and presented him with a plaque in recognition of his service. Mayor Williams also congratulated Battalion Chief Eric Bowen on his retirement. Court Clerk Cassidy stated that there would be no cost to the City to utilize American Municipal Services Corporation as a third-party collection agency and reported that approximately $500,000 in court fees is outstanding. City Manager Koral stated that the resolution also authorizes the collection agency to pursue unpaid sanitation fees, which total approximately $360,000. Community Center Supervisor Spear stated the City received two bids for the Community Center Cabinetry Improvements project and recommended awarding the bid to HL Management Service LLC doing business as HL Construction.
