Short-Term Rental License

A dwelling unit which is rented to a person for less than thirty-one (31) consecutive days, or is advertised to be rented for any period less than thirty-one (31) days is required to obtain a Short-Term Rental (STR) license.

The Rules

Annual license

STRs are required to obtain an annual license and inspection.

Occupancy

Each bedroom can have 2 occupants, with the potential for an additional 2 per floor. The maximum occupancy is 12.

Visitors

Visitors up to 1.5 times the maximum occupancy are allowed between 7 a.m. and 11 p.m.

Advertising

All ads must include the license number.

Good Neighbor Guide

The guide must be displayed in each STR. It outlines expectations for noise, trash, parking, etc. View Guide: CLICK HERE

Trash

Must provide at least one outdoor garbage can and one recycling bin. If occupancy is at six or more, at least two garbage cans must be provided.

Fireworks

STR owners must prohibit use by occupants and visitors.

Insurance

Insurance is required for all STRs.

Complaints

License holder/agent must address violations within 2 hours.

False reports

False reports about STRs is a violation.

Transfers

STR certificates and licenses are generally non-transferable and become void upon an attempted transfer of ownership. Limited exceptions for transfers can be found in the ordinance and require prior City approval.

Getting a License

  1. Fully complete the STR License Application.
  2. Submit a complete application and required attachments with the annual license fee of $540.00.
  3. City staff will review the application for completeness and compliance with the City’s STR Licensing Ordinance.
  4. The Fire Department will be notified and will contact you (or your agent) to schedule an inspection.
  5. The Fire Department will notify the City when the dwelling unit meets the inspection guidelines. If the property fails inspection, the applicant must pay $175.00 to the City of Saugatuck for each reinspection.
  6. Upon approval, the City will issue a Short-Term Rental License which will be valid for 1 year.

Renewing Each Year

  1. 60 days before it expires

    The renewal window opens

    The license holder or local agent may apply for a renewed license by submitting a renewal application to the enforcing officer no sooner than sixty (60) days prior and no later than thirty (30) days prior to the date that the license is set to expire, along with the license renewal fee established by the City's fee schedule.

  2. 30 days before

    The renewal deadline

    Renewal applications may be submitted no later than five (5) calendar days after this deadline, subject to a late fee established by resolution of the City Council.

  3. 25 days before

    The grace period ends

    Renewal applications submitted after this five (5) calendar day grace period by any amount of time shall be deemed untimely and shall not be processed by the City, and the short-term rental license shall be deemed expired.

  4. The expiration date

    The renewed license begins

    Once issued, a renewed license for a short-term rental shall take effect on the same day as the expiration of the prior license, such that a short-term rental license will retain the same expiration date from year-to-year.

A new fire inspection

Each year a new completed and signed fire safety checklist must be submitted, a new fire inspection must be conducted, and an approved fire inspection certification must be issued before a license can be renewed.

Deficiencies

The license holder shall have thirty (30) calendar days from the date the notice of a deficiency was sent to cure any deficiencies.

No reminder

It is each owner’s responsibility to know and keep track of their expiration date—the City will not provide you with any advance notice prior to your expiration date.

In a capped district

For existing STRs in R-1 zoning districts to continue to be eligible for a license, it is important to timely renew the license prior to expiration.

Finding Your Expiration Date

  1. Go to the Saugatuck BS&A website.
  2. Enter your address, parcel number, or owner name.
  3. Select the correct property.
  4. Click the building department tab.
  5. Under certificates, click view next to the current STR certificate or license.
  6. The expiration date will be displayed in the second column.

Caps in Six R-1 Districts

There is a cap on the number of short-term rentals in the following zoning districts:

  1. Community Residential R-1 67
  2. Peninsula South R-1 11
  3. Peninsula West R-1 10
  4. Maple Street R-1 7
  5. Peninsula North (Duneside) R-1 3
  6. Peninsula North (Riverside) R-1 2
The most short-term rental licenses each capped R-1 district may hold.

If a STR certificate or license expires while a cap is in effect, you will not be able to re-apply until the number of active short-term rental licenses in a zoning district falls below the maximum limit, at which point you will be subject to the City’s selection process for issuing available licenses.

The City is still accepting STR applications in other zoning districts that permit STRs.

At least once per year, the City provides notice of available licenses.

Accessory Dwelling Units

Accessory Dwelling Units are allowed on residential lots that contain an existing single-family home. ADUs are not counted toward the citywide short-term rental (STR) caps, but they are still regulated when used for STR activity.

Rent the primary home and the ADU together

Both units must be covered under a single STR contract.

No special land use approval is required.

Both units must hold their own STR licenses.

Rent the ADU separately while the owner occupies the main home

This requires special land use approval from the Planning Commission.

The owner must reside on the property.

The ADU must hold a separate STR license.

Renting an ADU independently from a single-family home requires special land use approval granted by the Planning Commission as authorized in Section 154.092(J).
