City Council Agenda Item Report FROM:

Luke Thompson Director of Planning and Zoning

DATE:

February 10, 2025

RE:

Accessory Dwelling Unit

DESCRIPTION: At the Planning Commission meeting on September 19, 2024, concerns were raised regarding the standards required for Accessory Dwelling Units (ADUs) to obtain Special Land Use approval for rental purposes. Owner occupying a single family home and separately renting an ADU requires Special Land Use approval. One of the key requirements is that the ADU must comply with all current zoning regulations. This creates an issue for legally nonconforming structures, as even though they can be occupied legally they are unable to rent due to the size or location of the structure. After several discussions on the feasibility of renting existing non-conforming ADUs and the minimum square footage requirements for new ADUs, the Planning Commission unanimously recommended an ordinance amendment. Drafted Ordinances and Policy Based on direction by the Planning Commission a text amendment was drafted for section 154.022 (W)(3) to revise the required minimum gross finished floor area for accessory dwelling units and to amend section 154.092 (J) to allow existing accessory dwelling units that do not conform to the requirements of 154.022 (W) to qualify for rental if all other applicable requirements are satisfied. LEGAL REVIEW: The City Attorney reviewed the draft ordinances, attended the Planning Commission meetings and will be at the City Council meeting to answer any questions.
