Moffat County Board of County Commissioners, Resolution No. 2026-87. Resolution Approving the Amended and Restated Investment Policy of the Moffat Economic Development Authority and Clarifying Certain Provisions of the Establishment Agreement.

Recitals

WHEREAS, pursuant to the Colorado Constitution, Article XIV, Sections 18(2)(a) and (b), and Sections 29-1-203 and 203.5 C.R.S., the City of Craig (the “City”) and Moffat County (the “County”) entered into the Moffat Economic Development Authority Establishment Agreement dated as of August 12, 2025 (as amended on October 14, 2025, the “Establishment Agreement”) to form the Moffat Economic Development Authority (the “Authority”); and

WHEREAS, pursuant to the Establishment Agreement, the City and the County approved an investment policy for the Authority (the “Investment Policy”); and

WHEREAS, due to the passage of Senate Bill 26-052, the Authority needs to amend the Investment Policy to expand the investments available to the Authority, and has requested the City and County approve said amendment; and

WHEREAS, additionally, the County would like to clarify the language in the Establishment Agreement regarding the end date of the terms of the Members of the Board of Directors of the Authority (the “Members of the Board,” and each a “Member of the Board”).

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MOFFAT COUNTY AS FOLLOWS:

Resolved

1) Approval of Amended and Restated Investment Policy. The Amended and Restated Investment Policy of the Authority in the form presented herewith is hereby approved.

2) Terms of the Members of the Board of Directors of the Authority. The County declares that, in accordance with its interpretation of the Establishment Agreement and the general practice of the County, the term of each Member of the Board shall last until December 31 of the year where said Member of the Board’s term is set to expire. This clarification is made in conjunction with the City and shall be deemed part of the Establishment Agreement.
